WARNING: VERY LONG POST!! My IRS situation is a disaster. I have a bunch of questions I need help with (CSED, CNC, Stimulus Check). Is anyone here knowledgeable about taxes, and bored, who feels like trying to help me fix my tax problems and make my IRS issues, and my life, a little less terrible?

Partial tl;dr:

Hello, y'all. I have posted in the Tax subreddit and asked for help in the past and I have received some helpful replied with lots of good information, but I haven't actually gotten around to doing anything to start to fix my situation (because my life has been an incredibly stressful, chaotic, miserable, exhausting mess, and I'm overwhelmed by the non-stop chaos and stress that I've been having to deal with, so the thought of actually trying to deal with this disastrous situation I find myself in, is something that I just haven't been able to get myself to start working on). The reason I mention this is because I want to express that I am genuinely grateful for people's time and efforts to try to help me, and to let people know that I'm not trying to waste anyone's time. Now, though, I will likely be out of work for at least another couple weeks, and possibly over a month, so it's a great opportunity for me to use this time to do something productive that will actually help me start to make my life better.

With that stated, I will genuinely appreciate any help that I receive!!!!!

First off, I have not filed a tax return in 9 years, since some time in 2011 (which would have included the 2010 tax year, which was the last year I filed a tax return for), when the IRS started garnishing my wages. After they started garnishing my wages, I called the IRS and got on a better payment plan, and then made those payments for a few months, until I lost my job in March of 2012 and got approved for Unemployment benefits. When that happened, I called the IRS and told them that I had lost my job, and they put a stop on my payment obligations. I'm not sure of this, but I think this may have been when the IRS deemed me to be CNC (Currently Not Collectible); which would have been in March of 2012.

It should be noted: I have not actually made any payments to the IRS *for my past due taxes*, since I lost my job in March of 2012 and the IRS put my payment obligations on hold. I have, however, been working and paying taxes, through my employer, since a year after that, when I got back in to the workforce in March/April of 2013. Since then, I have always elected to have enough money taken out of my paychecks to cover my income taxes, and I am almost certain that I should/would have had tax returns owed to me from the IRS each year since 2013, *IF I had been filing my tax returns.*

YES, it is entirely my fault for not filing my income tax returns for the past 9 years; and, yes, I realize that I have now missed out on the money that I could have received in tax returns for several of those years (anything prior to 2016, I believe) - even though, the tax return money I would have received from 2011-205 would have just been applied towards my past due tax debts. I just wanted to give this information, so that people will understand my current situation.

So, for starters, I would like to figure out what the best way to go about getting caught up on filing my tax returns for the past 9 years would be. Yes, I would like to try to get a Stimulus Check, as I could most definitely use the financial help right now. And before people start to criticize, berate and belittle me, there's a reason that the IRS deemed me to be CNC several years ago, and it's because having to make payments to them would have definitely created a hardship for me. Furthermore, I don't smoke, drink, nor do drugs; I live a very simple, modest lifestyle (I've largely become a homebody/recluse); and I have been paying income taxes every year for the past 9 years (and should have had money coming to me each of these years) - and the main reason that I owe the past due tax debt that I owe (which is around $21,000 now, I believe), is all from 3 years, 2007, 2008 and 2009 - and a significant amount (probably, more than half) of that $21,000 is from casino jackpot winnings that I won over those 3 years - which I ALWAYS lost back to the casino - but that I was just too stupid to have filed my taxes properly for, and used my losses as an itemized deduction to balance out the taxes owed from those jackpot winnings - and that's why I put of filing my taxes for so many years, because I (mistakenly) thought that I could just file an Amended Tax Return for 2007, 2008 and 2009 and clear this tax debt up, by claiming my losses against my jackpot winnings. Obviously, this is not longer a possibility, as you only have 2 years after the filing deadline to file an Amended Tax Return, so I missed out on this option, for all of these tax years, around a decade ago.

Also, for the record, I have now not gambled in almost 6 and-a-half years. I still hate myself, for all of the harm and damage that I caused when I was gambling, though. I just thought that some of you might want to hear that, and that it might make someone be a little more inclined to try to help me, because I know that lots of people love to be judgemental on here.

I'm sorry for that overly-thorough explanation/rant there. I know how people here on Reddit can be, though; and I didn't want to offer no explanation about why I still owe over $20,000 in back taxes and why I haven't filed taxes in almost 10 years, and invite people to complain and berate me for not paying my tax debts and/or for not filing my tax returns for the past 9 years.

So, can anyone make a good suggestion about how to proceed to try to get a Stimulus Check?

Yes, I am aware that I need to fix this past due tax problem that I have, and I will work on that, and I want to work on that - but, in the meantime, I would like to be able to buy some food, pay my rent and some bills, and stop stressing about money every single day. If I can file the necessary recent tax returns (2018, 2019) to at least be eligible for a COVID-19 Stimulus Check, that would automatically put something towards my past due tax debts and bring that amount down some (from the tax return monies that will be intercepted by the IRS, from my 2018/2019 tax years).

From what I understand, I will need to file either my 2018 and/or 2019 tax return(s), to even possibly be eligible for a Stimulus Check. However, considering my situation, and that I haven't filed a tax return since my 2010 tax year, could I just start off by filing one/both of my tax returns for these past 2 years, while not having filed any of my prior tax returns for 2011 to 2017? Or, will I need to file all of these tax returns, in chronological order, starting with my 2011 tax return?

Or (as was suggested to me), can I actually just file my tax return for 2018 and/or 2019 electronically, get the tax return processed, hope to get a Stimulus Check (which I definitely should be eligible for, being that I made much less than $75K each of the past 2 years), and then go work on filing all of the other tax returns that I still need to file, since the 2011 tax year?


Secondly (and I know this post is already way too long, and I apologize for this), after posting on here to ask for help over a year ago, I learned about the CSED and that it's possible that some of my past due tax debts may have expired, due to the Collection Statute Expiration Date. However, I am not certain of how to figure this out and to determine whether or not any of my old tax debts have actually expired. And with the IRS phone lines currently not being open, I can't just call and ask them (and I don't know that they could/would answer this CSED question for me, if I asked it). Also, because nothing seems to be simple and convenient for me, I can't just create an account on the IRS website, because part of the My Account verification process on their website requires that you have information for some type of loan, credit card or mortgage, and I happen to not have any of those types of accounts, and because of this, I am literally not able to create an account on the IRS website.

However, I did find a big envelope that the IRS sent me back in December of 2016 - after I had reached out to them to start trying to fix this back then - that happens to include the Tax Transcripts for several of my tax years. Specifically, it does look to include my Tax Transcripts for 2007, 2008 and 2009 (the 3 years that I owe back taxes for), so I'm *thinking* that this may have the information necessary to determine when the actual CSED dates are. Unfortunately, I do not know what the actual information is, that will determine when the 10-year Collection Statue Expiration Date clock began ticking.

From what I understand, the CSED clock does not just automatically start on the Tax Filing Deadline Date for when a tax return should have been filed by; it actually starts based on the 'assessment date' or actual 'filing date' when the tax return was filed.

For example, my 2008 tax return should have been filed by April 15th, 2009 - but I did not file it on time - so (if I understand it correctly) that 2008 tax debt did not automatically expire 10 years after the filing deadline, which would have been in April of 2019. Unfortunately, I also did not file my 2009 or 2010 tax returns on time, so they also did/will not expire 10 years after the respective tax year filing deadline date, to my knowledge.

What (I think/what I was told) actually happened was that the IRS apparently filed my tax returns for those 2-3 years (2008, 2009, 2010), when they decided to start garnishing my wages, and this was some time in 2011. So, am I correct to assume that the CSED clock for these 3 tax returns did not start counting down until 2011? Since this is when a return was actually filed for them?

Also, being that I was deemed by the IRS to be CNC (Currently Not Collectible) in 2012 or 2103, does that mean, or is it even possible, that the CSED clock was put on hold while I have been in CNC status? Or, was the CSED clock still running, even while being Not-Collectible?


Finally, I will try to finish this ridiculously long post. If feasible, here's what I'm hoping to do:

I will file my 2018 and/or 2019 tax returns and hope to get a Stimulus Check next month. The money I am owed from the IRS in returns for 2018/2019 will be intercepted by the IRS/Treasure Department and applied towards my past due taxes, which will bring down the amount I owe a little bit (presumably, a few hundred dollars). After I have filed the necessary tax return(s) from the past year or two, to try to speed up the process to (at least try to) have an opportunity to receive a Stimulus Check, I will then go back and start to file my tax returns from 2011 until I am current/caught up on all of them.

If I do that, and file for my 2018 and/or 2019 tax returns, being that I will no longer be eligible for any tax returns that I would have been due from 2011 to 2015, should I even bother filing returns for those 5 years? Or, as someone else suggested, should I not worry about filing returns for those 2011-2015 years right now, and just file returns for 2016 through 2019 and see what the IRS responds and says? Or, should I go ahead and file returns for every years since 2011, so that I am completely caught up on my tax returns?

And, finally, once I have filed all of the tax returns that I should file, which should bring my past due tax debt down by (I'm guessing) $1,000 to $2,000 (based on what I think I should have coming form my tax returns from 2016 through 2019), what could I do to try to negotiate with the IRS about the remaining tax debt that I will still owe?

Being that any type of significant lump sum payment will not be a realistic option for me to offer to make, and that my past due tax debt will probably still be around $20,000 (unless, the CSED has come and gone for 2007, 2008 and/or 2009), will they probably just want me to get back on a payment plan, where I pay like $50-$100 per month? Or would they even be willing to accept a payment plan with payments that small, on a debt that large?

Also, someone mentioned something called an OIC (Offer In Compromise) that (I think) can possibly help to agree to a settlement that can wipe out a tax debt altogether, but that there are certain requirements that need to be met; and I don't know if that's something I will be eligible to request, even after filing all of my tax returns and being current on filing them

Also, is it possible that I will still be able to remain in CNC status, after filing all of these tax returns? Or, once I file all of my tax returns and am current on filings, will I be forced to start making payments again? It's not like receiving this Stimulus Check is going to get me out of debt and afford me a better lifestyle, and even having to pay $50-$100 per month would present a problem for me and would be a financial hardship; but I don't know if filing all of my tax returns and/or receiving a Stimulus Check will automatically take me out of CNC status. So, I am trying to figure out what to expect to happen after I file all of my tax returns from the past 9 years, and what to anticipate the best way to go about this situation will be.

Warning: LONG POST!! - I haven't filed a tax return in 7 or 8 years, I owe around $20K from previous years, I have worked almost this entire time, I would be very grateful for some helpful advice!! (Currently in Arizona)

This is probably going to be a long post. I will plan on trying to do a Tl;dr after I finish it, but I'm not sure if I'll be able to do one properly. If some of you would be willing to take the time to read my entire post and try to offer me some help/advice, I would sincerely appreciate it.

Here's my situation: I currently owe the IRS around $20,000 (from taxes owed from between 2006 and 2011) and I have not filed a tax return in 7 or 8 years (since some time in 2011, I think), and I have worked almost this entire time. However, I was out of work and collecting unemployment for almost a full year (from around April of 2012 until around April of 2013). Before I was fired from my job, in March of 2012, I had been on a wage assignment agreement with the IRS for a few months, after they started garnishing my wages some time in 2011.

After I lost my job in March 2012, I was almost immediately approved for unemployment ($1,100 per month, the max. amount allowed in Florida, at the time), so I contacted the IRS and let them know that I was no longer working and they were very nice and helpful and put a hold on my wage garnishment. I ended up moving back to Arizona while I was unemployed and, fortunately/coincidentally, I started a new job in April of 2013, the same month that my unemployment benefits were set to expire. I ended up communicating with the IRS at this time, and let them know that I was about to start working again, after not working for around a full year, and, again, they were really nice and understating about it. They told me that they realized that I could still use some more time to get back on my feet, after returning to the workforce, so they were happy to give me some more time to try to get set financially and that they would continue to hold off on my wage assignment agreement for a while.

Well, this was back in April of 2013 - almost 6 years ago - and I have not paid anything extra towards that wage assignment agreement, nor have I filed a tax return during any of the past 7 years. I have, however, been employed this entire time (since April 2013) and have been paying taxes on my income; and I have been paying more taxes than I owe each year; so, my tax debt/amount owed should have gone down significantly over these past 6 years. Being that I have now not filed taxes in over 7 years, though, I have not known how to proceed, or even where to try to start, and the thought of trying to figure out what to do has been overwhelming. So, I have done almost nothing about my tax situation. Which, I know, is really stupid; but, my life has not been easy and I have just been trying to get through the tough times and not lose my mind in the process.

About 2 or 3 years ago, I did actually call the IRS again and had a long conversation with an agent, explaining my situation, and he mailed me my tax information (W2 papers, I believe) for the previous 8-9 years (if I recall correctly). I actually still have that envelope with the papers that the IRS sent me, but I have not even opened it. Yes, again, very stupid, I know; but I am apparently quite stupid sometimes, and I am scared about where to even try to being working towards resolving this matter.

Part of the reason that I haven't done more/anything about this tax situation, is because of something that likely nothing can be done about now (because of how much time has passed); and because of this, it is something that has angered and frustrated me tremendously. That thing is that I likely should not have owed the majority of the $20K in back taxes that I owe, because they were from casino jackpot winnings - which I gambled and lost back 100% of. I was a compulsive gambler, so I, literally, always, lost back 100% of my winnings; along with much/most of my income for 19 years of my life. And because I have put off filing my tax returns for years at a time, I have almost surely lost the eligibility of filing an amended tax return for any of the tax years that I owe back taxes for (2006-2011) and claiming my losses to offset my jackpot winnings.

So, before I forget, I do specifically want to ask, what is the maximum amount of time allowed to be able to file an amended tax return? Being that it is now January of 2019, what is the last year that I might be eligible to file an amended tax return for? My guess is that the amended return cutoff is later than 2011, which will likely do me little/no good. If, at all, possible, I would really like to be able to claim my gambling losses against my jackpot winnings, but I'm afraid that I have now missed out on that opportunity, because too many years have elapsed.

So, assuming that nothing can be done about the years of 2006-2011 (particularly, because I already filed tax returns for those years), how should I proceed now? Obviously, I need to file tax returns for each of the past 7 years (2012 to 2018), but, how, and where, should I begin?

Also, for the past 2 years and 6 months, I have had a long, brutal work commute (76 miles each way, through massive/steep mountains, costing me about $15-$20 per day in fuel costs), but (foolishly) I only started keeping my gas receipts about a year ago. Could I even try to claim my a tax deduction for my mileage/fuel costs for the past 2-plus years? Or could I only claim a deduction for the receipts that I have? I have no idea how much/how significant a tax deduction fuel costs/mileage may help me get, but my commute has already ruined a vehicle (a blown head gasket on my 2001 Honda Accord, that hasn't started since) and spending $15-$20 a day just to drive to and from work is miserable and frustrating, to put it mildly. Not to mention, is stressful and exhausting. And coupled with the $20,000 that I owe in back taxes, I am looking for any and help/deductions I can get.

And with regards to the year and-a-half that I was commuting 150 miles per day, but not saving my gas receipts, could I just show the date my employment at my present employer started, and that my address has been the same since before then, and be eligible for some sort of estimate of travel mileage/fuel costs? Or will I need gas receipts for everything I'm trying to claim a deduction for?

OK, I think I'm actually going to try to finish this now. I am seriously sorry for writing such a lengthy post. And if anyone has actually read my entire post and would be willing to try to help me with some advice, information and/or suggestions, please know that it would be genuinely appreciated!!

One more thing. If anyone who reads this is actually in Arizona and might want to try to meet with me in person (if I am allowed to mention this) and look over my paperwork with me, I would be open to that. For the record, I live in Payson and work in Scottsdale, so I would be open to meeting anywhere within reason, as this is something that has been affecting my life for over a decade now and is something that I would really, genuinely like to try to get resolved. So that, maybe, I can actually start getting some back at the beginning of the year again!

Edit: I wanted to mention that I have currently not gambled in over 5 years, since October 4th, 2013. So, 5 years, 3 months and 14 days, in case anyone is curious about that. I have legitimately and truly tried to change my life for the better, as I have a 19 year-old son, a 21 year-old daughter and a 7 month-old grandson and that is what has kept me going through the truly difficult times. So, if someone does actually read my post and decides to try to help me, please know that your time and efforts will not be wasted, nor taken for granted!!

Edit 2: Also, for the record, I hate myself for being a compulsive gambler for 19 years; for all of the money I wasted and the hard times I put my family through, because of my choice to gamble. I lost so much more money than I won that it sickens me to think about it, literally. I have so much guilt and regret, that have been such a heavy burden on me, that it has literally affected my quality of life for over 20 years now. Stress headaches, fatigue, missing work, numerous humiliating situations, a credit score below 500 for most of the past two decades, and almost-constant struggles, all that have made life to be no fun many times over the years. I have left the casino crying, said absolutely horrible things and had horrible thoughts, lost a job, and have ruined years of my life and my family's lives, because of the losses I endured from my gambling. I have literally not ever done an illegal drug, I didn't get drunk until my 21st birthday and haven't ever been much of a drinker, and, other than trying a few times as a kid, I haven't smoked or chewed tobacco; so I think that's why gambling had such a hold on me for so many years. For me, it was like a drug, and it was most definitely an addiction. So, I want to make it clear that I recognize that I was responsible for most of my problems and that I have paid a very high price because of the choices I made. Maybe, no one gives a shit about this; but I felt like sharing it, as it's something that I still think about often and is something that I thought might help inspire someone to want to try to help me get out of the mess I currently find myself in with the IRS.

Online Casino withheld a jackpot win, online regulators have ruled in my favor, what happens if casino still wont pay up?

So yeah, as per the title. I won the jackpot on a slot machine (5 figures) and the casino withheld my balance, closed my account and when I asked them about the issue they quoted a vague paragraph from their T's & C's.

I then went to the independent regulators who opened up an investigation, ruled in my favour and then gave the casino 5-7 days to contact me to set up payment of my funds.

What do I do if the casino does not contact me? They have dragged their heels on every support ticket I have opened with them about this and I'm certain one of the reasons they lost their case with me was because they didn't bother providing evidence to fight my claim
